GENERAL CONDITIONS OF ONLINE SALE

 
The company PARI CUCINE S.R.L., with registered office in Rimini (RN), Via Crimea n. 3 (ZIP code 47921), P. IVA 00318210408, registration number with the Companies Register of Rimini 144353, (infra and for "PARI CUCINE"), licensee of the trademark "Furniture Pari", makes it available to all users the ability to purchase by internet the products listed on the website www.arredamentopari.com (hereinafter "Site").
 
General Provisions
 
The general conditions of sale online indicated (below under the "GENERAL CONDITIONS") are effective only between the company PARI CUCINE and any person who makes purchases online on the website www.arredamentopari.com as a consumer / professional, as defined by the art. 3 of the Consumer Code (infra and for brevity the "CUSTOMER or "CUSTOMERS").
These GENERAL CONDITIONS are drafted in compliance with the provisions of the Consumer Code, as per Legislative Decree no. n. 206/2005, amended by Legislative Decree no. n. 21/2014 and by Legislative Decree. 70/2003, in the field of electronic commerce.
PARI CUCINE has the right to modify these GENERAL CONDITIONS. In the event of a change, the GENERAL CONDITIONS published on the Website at the time the order is sent by the CUSTOMER will be applied to the purchase order.
 
ARTICLE 1 - Object of the contract

The CUSTOMER acknowledges that purchases made through the Website do not benefit from any initiatives of greater favor practiced by PARI CUCINE on purchases made at their points of sale.

  • the main characteristics of the Products;
  • the total price of the Products including taxes, shipping costs and any other costs;
  • the methods of payment, delivery and execution, the date by which PARI CUCINE agrees to deliver the Products, the handling of complaints by PARI CUCINE;
  • the conditions, terms and procedures for exercising the right of withdrawal pursuant to art. 54, paragraph 1, of the Consumer Code, as well as the standard withdrawal form referred to in Annex I, part B of Legislative Decree 206/2005;
  • the information that the CUSTOMER will have to bear the cost of returning the Products in case of withdrawal;
  • the existence of the legal guarantee of conformity for the Products purchased.

ARTICLE 3 - Conclusion and effectiveness of the contract
 
The CUSTOMER can purchase the Products present on the Website www.arredamentopari.com, as described in the relevant information sheets, which show the main features of the same. It is understood that the image accompanying the information sheet of each Product is purely representative of the same and may not correspond to its exterior features, from which it may differ in color and size.
The CLIENT to place the Order must use the electronic cart on the Site by entering the data required by the order procedure (hereinafter "Order Procedure"). To proceed with the compilation of the Order, the CLIENT must alternatively follow one of the following procedures:
a)in the event that the CLIENT is already registered on the Site (hereinafter  "Site User"), it will be sufficient to enter their credentials access (username and password) in the "Login" section;
b)in the event that the CUSTOMER is not a User of the Site, he may at his choice: i) make the related registration online in the "Register / Login" section; ii) proceed with the purchase without registration in the "Proceed without registration" section.
The Order Procedure allows the CLIENT to view, before sending the Order to PARI CUCINE, a web page containing the details of the Order, and in particular: i) the Products selected for purchase; ii) the unit price of each individual Product; iii) the total price in case of purchase of more Products; iv) shipping costs; v) any additional costs; vi) the geographical address indicated for the delivery.
The Contract will be concluded with the receipt by the CUSTOMER of the Order Confirmation mail that PARI CUCINE will send to the email address indicated during registration. The Order Confirmation summarizes all the data entered by the CUSTOMER during the compilation of the Order, and in particular: i) the Products; ii) the unit price of each Product selected for purchase, the total price in case of purchase of more Products, shipping costs and any additional costs; iii) the order number; iv) the geographical address indicated for the delivery; v) the link to download and store a copy of these GENERAL CONDITIONS.
The CUSTOMER undertakes to verify with the utmost care and attention the correctness of the data contained in the Order and in the Order Confirmation and, in the latter case, to communicate to PARI CUCINE, within 24 (twenty-four) hours from receipt of the Confirmation Order, any adjustments to these data. The corrections of the data contained in the Order and in the Order Confirmation may result in the cancellation of the Order by PARI CUCINE.
It is understood that the sending of the Order by the CLIENT implies the full knowledge by the same of these GENERAL CONDITIONS and their full acceptance.
 
ARTICLE 4 - Availability of Products
 
The availability of the Products refers to the actual availability at the time the CUSTOMER sends the Order. This availability is to be considered purely indicative because, due to the simultaneous presence on the Website of multiple users, the Products could be sold to other customers before the Order Confirmation.
If, following the sending of the Order Confirmation, the Products ordered by the CUSTOMER are not, in whole or in part, available, PARI CUCINE will communicate it without delay to the CUSTOMER by e-mail to the e-mail address indicated by the latter. of registration. In the event that the CUSTOMER has already paid for the Products not available, the relative price will be reimbursed by PARI CUCINE and the Order will be considered canceled, except for any part of the Order related to the Products available.
In no case PARI CUCINE may be held responsible for any direct or indirect damage of any kind, whether contractual or non-contractual, in any case arising from the non-availability of one or more Products, to any due cause.
On some Products PARI CUCINE reserves the right to limit the quantities that can be purchased, as in the case of promotional sales of contingent products.
 
ARTICLE 5 - Prices
 
All sales prices of the Products indicated in the individual information sheets on the Site are expressed in Euro and include VAT, and they vary automatically according to the collection and quantities.
Shipping costs are not included in the sale price of the Products and are separately highlighted and detailed in the Order and in the subsequent Order Confirmation, based on the provisions of the following art. 8.
The CUSTOMER accepts the faculty of PARI CUCINE to change the purchase prices and shipping costs of the Products at any time; however, the CUSTOMER will apply the price and shipping costs detailed in the Order and in the subsequent Order Confirmation.
The Products for sale under the "Offer of the Week" and "Domestic Appliances" are not subject to further discounts, including the discount applied in case of subscription to the newsletter.
Promotions cannot be combined.
ARTICLE 6 - Methods of payment

The CUSTOMER will have the right to payment for orders over € 800.00 by paying, by bank transfer to the coordinates above indicated, 30% down payment for production start-up and 70% down payment before shipment.
In the case of payment by PayPal, the CLIENT must carefully check that the shipping address entered on PayPal matches the one entered during the compilation of the Order.
To proceed with the payment via CartaSi, the CLIENT must enable his credit card to the 3D Secure or SecureCode. Total or partial refunds will be made with the same type of payment chosen at the time of order (Credit Card, PayPal, Bank Transfer). The currency used for repayment will always be the euro, even in the case of transactions in different currencies; the sum received from PARI CUCINE will be credited net of the bank charges incurred.
Once the payment has been made, PARI CUCINE will issue the invoice relating to the Order sending it by e-mail to the person in charge of the Order to the addresses indicated by the CUSTOMER during the compilation of the Order. In the event that, within 48 (forty eight) hours from the Order Confirmation, the holder of the Order does not receive the invoice by e-mail, the same can contact PARI CUCINE through the "Contact" section. For the issuance of the invoice, the information provided by the CLIENT itself will be considered when the Order is completed. PARI CUCINE recommends that the CUSTOMER check the accuracy of the information and data provided with the utmost care.

ARTICLE 7 - Shipments and deliveries
 
PARI CUCINE carries out the delivery of the Products (hereinafter the "Delivery") by couriers specialized in transporting furniture and furnishings to the address indicated by the CUSTOMER during the compilation of the Order in the section ""delivery datagoods".
The CUSTOMER can collect the Products from the warehouse directly at the PARI CUCINE headquarters by selecting the "Pick-up" method On-site delivery.
Products ordered with the "Withdrawal on site" procedure must be picked up by the CUSTOMER within 30 days of receipt of the Order Confirmation. If the CUSTOMER does not collect the Products from the PARI CUCINE headquarters within 30 days from receipt of the Order Confirmation, PARI CUCINE may charge the CUSTOMER for any storage costs.
 
ARTICLE 8 - Shipping costs Shipping

For shipments to be made in countries other than Italy, the Republic of San Marino, France and Germany the CLIENT is invited, before placing the Order, to ask PARI CUCINE for an estimate by clicking on the "Request Estimate" section by filling out the relevant form. PARI CUCINE will notify the CUSTOMER as soon as possible of the shipping costs and delivery times that may vary depending on the destination.
At the time of shipment to the CUSTOMER the tracking number will be provided in order to monitor the status of the shipment.
Shipments are insured against the risk of damage and loss of the Products; this insurance is valid and effective on the entire Italian territory until the delivery of the Products to the address indicated by the CUSTOMER during the compilation of the Order and does not involve any additional cost for the CUSTOMER.

Deliveries to be made outside the national territory are not subject to promotions regarding shipping costs.
ARTICLE 9 - Delivery

PARI CUCINE will notify the CUSTOMER as soon as possible of the shipping costs and the Production-Shipping Times that may vary depending on the destination.
PARI CUCINE undertakes in any case to deliver the Products to the CUSTOMER within 30 days of the expiry of the Production-Shipping Time.
In accordance with the art. 61 of the Consumer Code, bearing in mind that the Products sold on the Site are listed in the category of "goods to be packed or purchased especially for the Customer", in the event that PARI CUCINE does not deliver the Products within the agreed term CUSTOMER, or within the maximum term of 30 days from the expiry of the Production-Shipping Time, the CLIENT has the obligation to invite PARI CUCINE to make the delivery within an additional period appropriate to the circumstances, except as provided by the art. 61, fourth paragraph, of the Consumer Code.
If PARI CUCINE does not deliver the Products to the CUSTOMER within the additional period granted by the latter, the latter will have the right to withdraw from the Contract without any penalty, and PARI CUCINE will refund the CUSTOMER the payments made (for orders including multiple products not complementary or belonging to different collections, the CUSTOMER can withdraw from the purchase of only products that are delayed).
PARI CUCINE operates constantly in order to respect the Production-Shipping Times. In the event that the CUSTOMER needs to receive the Products before the expiry of the Production-Shipping Time, the Customer is invited to contact PARI CUCINE through the "Contact" section before proceeding with sending the Order.
The Production-Shipping Times are considered accepted at the time of sending the Order by the CLIENT.
Please note that production and shipments scheduled in the period before Christmas or summer holidays (August) may be subject to substantial delays (even a slight unexpected delay before a closing period such as Christmas holidays or August could result in the postponement of delivery upon reopening of the action in January and September).
 
ARTICLE 10 - Telephone notice
 
PARI CUCINE will inform the CLIENT of the shipment of the Products by email.
Before delivery the CUSTOMER will be contacted by telephone by the courier in charge of transport to agree on the date and time of delivery.
For this reason the CLIENT is invited to indicate during the compilation of the Order a telephone number (possibly portable) on which he wishes to be contacted.
 
ARTICLE 11 - Delivery / receipt of goods
 
The Delivery will be made to the address indicated by the CUSTOMER during the compilation of the Order in the "data delivery" section.
The standard delivery is to be understood at street level and the CUSTOMER is invited to collaborate with the driver to unload the packages from the truck, if necessary providing other people according to the size and weight of the Products purchased.
For deliveries to the floor the CUSTOMER must send to PARI CUCINE an express request through the section “Order note” son the Site, specifying the floor number and the dimensions (height and width) of the stairwell, which will allow the passage of the neck and handling personnel.
It is the CUSTOMER's responsibility to verify the feasibility of delivery to the floor and check the size of the transit areas.
The delivery service to the floor could result in a surcharge of shipping costs if it is necessary to reach unloading places that require special conditions and / or the use of equipment other than the usual ones and / or in the case of particularly bulky packages.
At the time of delivery, the presence of the CUSTOMER or a person of his trust is required to check that the packaging is intact and that the Products received correspond to what is indicated in the Order.
In case of non-integrity of the packaging (eg packaging tampered with, ruined or wet) the CLIENT, or his agent, must report on the transport document before proceeding to open the package, specifying the nature of the packaging. defect / fault detected.

ARTICLE 12 - Packing
 
PARI CUCINE shall pack the Products for transport.
 
ARTICLE 13 - Assembly
 
All Products are delivered already assembled or pre-assembled. In special cases the Products are accompanied by assembly instructions that will also allow the less experienced Customer to proceed with assembly.
 
ARTICLE 14 - Right of withdrawal
 
The CLIENT has the right to withdraw from the contract, without indicating the reasons, within 14 (fourteen) days from when the same or a third party appointed by him (i) received the Product (i) in the case of purchase more Products delivered separately but included in one order, received the last product.
To exercise the right of withdrawal, the CUSTOMER must inform PARIS CUCINE of the decision, by sending an explicit declaration or by using the withdrawal form referred to in Annex I part B of Legislative Decree no. 206/2005, attached to these GENERAL CONDITIONS under Annex A).

In compliance with the provisions of art. 59 of the Consumer Code, the right of withdrawal by the CLIENT is excluded "for non-prefabricated goods produced on the basis of an individual choice or decision of the consumer" (Directive 2011/83 / EU of the European Parliament) and for "goods packaged on measure or clearly personalized"(Article 59 of Legislative Decree 21/2014), taking into account the high level of customization that characterizes the Products of PARI CUCINE and its production processes that occur mainly on the orders of its suppliers, the right of withdrawal is not Applicable to a large part of the Products on the Site.

The CUSTOMER may exercise the withdrawal also limited to individual Products covered by a single Order, without prejudice to the impossibility of exercising the withdrawal relating to a part or component of a single Product.
In case of withdrawal by the CUSTOMER, if the Products have already been delivered, the CUSTOMER must return them intact, in their original packaging, complete with all their parts, including the order reference, the transport documents and the original invoice. o the accompanying document, to PARI CUCINE at its headquarters in Rimini (RN), Via Crimea n. 3 (CAP 47921), without undue delay and, in any case, within 14 (fourteen) days from the date on which the withdrawal was sent.
The return of the Products subject to withdrawal must be made at the care and expense of the CUSTOMER by courier of his choice. PARI CUCINE will not accept the return labeling method under any circumstances.
The withdrawal is excluded if the CUSTOMER returns the damaged or incomplete Product, or missing parts, accessories and / or components, including instruction manuals, licenses, warranties, etc., or without its original packaging intact.
PARI CUCINE will not be responsible in any case for damage, theft or loss of the Products returned to us until they have been taken over.
In case of valid withdrawal, the CUSTOMER will be reimbursed for the payments made, including shipping costs (with the exception of additional costs resulting from the choice of the CUSTOMER of a type of delivery different from the less expensive type of delivery offered by PARI CUCINE), without undue delay and in any case no later than 14 (fourteen) days from receipt of withdrawal. This payment will be made by PARI CUCINE by bank transfer to the IBAN coordinates indicated by the CUSTOMER.
PARI CUCINE reserves the right to suspend reimbursement until receipt and verification of the Products returned.
 
ARTICLE 15 - Legal guarantee of conformity
 
The CLIENT has the right to make use of the legal guarantee provided for by the Consumer Code in articles 128 to 132 (infra and for brevity the "Guarantee"). This Guarantee provides, inter alia, that the CLIENT, under penalty of forfeiture, denounces to PARI CUCINE, by mail to info@arredamentopari.com, any conformity defects found on the Products within 2 (two) months from the discovery (Article 132, Consumer Code). Following this complaint, the CUSTOMER will have the right to request the repair or replacement of the Product, without prejudice to the other rights provided by law, without expenses in both cases, unless the remedy requested is objectively impossible or excessively burdensome compared to the other. By virtue of the above warranty, PARI CUCINE is responsible for any conformity defects that occur within 2 (two) years from the delivery of the Product. Beyond this term, PARI CUCINE will no longer be held responsible for the conformity defects found by the CUSTOMER. In the event of replacement or repair of the Product, the terms of the Product Warranty given in replacement or resulting from the repair are the same as the original Product. Therefore, the two-year total duration of the Guarantee will in any case start from the delivery of the original Product. In order to benefit from the Warranty, the CLIENT is recommended to show the purchase document. In any case, reference is made to the regulation of the legal guarantee to the Consumer Code regulations referred to in Articles 128 et seq.
 
ARTICLE 16 - Responsibility
 
PARI CUCINE assumes no responsibility for disservices due to force majeure or accidental events, even if they are dependent on malfunctions and / or disservices of the Internet, which prevent the execution of the Order within the foreseen time frame.
 
ARTICLE 17 - Complaints
 
The CUSTOMER may address any complaints to PARI CUCINE:

ARTICLE 18 - Access to the site
 
The CLIENT has the right to access the site for consultation and purchase. No other use by the CLIENT, in particular commercial, of the Site and its contents is permitted. The integrity of the elements of the Site, whether they are sound or visual, and the relative technology used, remain the property of PARI CUCINE and are protected by the right of intellectual property.
 
ARTICLE 19 - Cookies

ARTICLE 20 - Conferment and processing of personal data

The CUSTOMER data are processed by PARI CUCINE in compliance with the provisions on personal data protection, as specified in the information provided in the specific section "Information pursuant to Article 13 of EU Regulation 679/2016" .
 
ARTICLE 21 - Integrality
 
The present GENERAL CONDITIONS are constituted by the totality of the clauses that compose them. If one or more provisions of these GENERAL CONDITIONS were deemed invalid and / or ineffective the other provisions will continue to have full validity and effectiveness.
 
ARTICLE 22 - Applicable law and jurisdiction
 
The present GENERAL CONDITIONS are governed by Italian law.
Any dispute that may arise between PARI CUCINE and the CUSTOMER regarding the interpretation and / or execution of these GENERAL CONDITIONS will be subject to the exclusive jurisdiction of the judge of the place of residence or domicile of the CUSTOMER, if he possesses the status of consumer according to 'art. 3 of the Consumer Code. Otherwise the Court of Rimini will have exclusive jurisdiction.
Both Parties have the right to initiate out-of-court settlement procedures for the resolution of disputes, also by electronic means, in compliance with the provisions of art. 141 of the Consumer Code.
